According to an Economic Times report, the review will assess emerging technologies and evolving network management practices, including 5G network slicing and differentiated connectivity services.
The DoT has asked TRAI to examine whether the current regulatory framework continues to adequately protect consumer interests, maintain service quality, support the orderly development of telecom services, and preserve the principles of fairness, transparency, and equal treatment of internet traffic.
India’s net neutrality regulations are based on recommendations issued by TRAI in 2017 after widespread public discussions surrounding differential pricing models and zero-rating platforms such as Meta Platforms’ Free Basics. Under these rules, telecom operators and internet service providers are required to handle all internet traffic without blocking, throttling, or giving preferential treatment to specific content or services for commercial reasons.
The issue recently returned to the spotlight after Bharti Airtel launched a premium postpaid plan powered by 5G network slicing, offering improved network performance during periods of heavy congestion. Although Airtel stated that the service complied with net neutrality by remaining content-neutral, the offering drew criticism from industry observers and rival operator Vodafone Idea, who questioned whether such differentiated services fit within the existing regulatory framework. Airtel subsequently rebranded the service as Fast Lane while continuing to use the same underlying technology.
According to the DoT, India’s telecom industry has changed substantially since 2017, evolving from a predominantly voice-based market to one centred on data consumption. The widespread rollout of 4G and 5G networks, increasing adoption of cloud-native network architectures, and the rapid expansion of over-the-top (OTT) communication platforms have significantly transformed the way telecom services are delivered and used.
The department also observed that 5G introduces advanced capabilities such as ultra-low latency, faster data speeds, and support for massive numbers of connected devices through technologies including network slicing, edge computing, and Massive MIMO. These innovations enable operators to create multiple virtual networks on shared physical infrastructure, with each network optimised for specific bandwidth, latency, security, and reliability requirements.
Looking ahead, the DoT noted that global efforts to develop 6G standards are already in progress, with anticipated applications including AI-driven networks, immersive communication technologies, integrated sensing capabilities, and direct satellite connectivity. In this context, the department believes it is important to reassess whether the existing net neutrality framework remains suitable for supporting innovation while maintaining an open internet, protecting consumers, and enabling efficient network management.
To keep pace with technological progress, the department has recommended periodic reviews of the net neutrality framework so that India’s regulatory approach remains modern, adaptable, and aligned with the rapidly evolving telecommunications landscape.
